1. Purpose and scope

These Terms of Sale govern sales of KYROX products made on www.kyroxprotein.com (the "Website") between Fitora, SASU with a share capital of €100, RCS Paris, 166 quai de Jemmapes, 75010 Paris, France (the "Seller"), and any individual acting for non-professional purposes (the "Customer"). Placing an order implies full acceptance of these Terms of Sale, available at any time on the Website.

2. Products

The products offered are dietary supplements in gummy form made with whey protein isolate. Their essential characteristics (ingredients, nutrition facts, allergens, directions) are shown on each product page and on the packaging.

Warnings: do not exceed the recommended daily intake shown on the packaging. Dietary supplements should not replace a varied, balanced diet and a healthy lifestyle. Contains milk (whey). Pregnant or nursing women and children should consult a healthcare professional before use. Keep out of reach of young children. Store in a cool, dry place.

Photos are for illustration purposes. Offers are valid while stocks last.

3. Prices

Prices are displayed in the currency of the delivery country (USD for the United States). They do not include shipping costs, which are shown before the order is confirmed. Discounts on 2- and 3-bag packs are applied automatically in the cart. The Seller may change prices at any time; the applicable price is the one displayed when the order is confirmed.

For deliveries outside the European Union, customs duties, import taxes or sales taxes may be payable by the Customer.

4. Orders

The Customer selects products, checks the cart and total price, then confirms the order and pays. The sale is concluded upon payment confirmation. A confirmation email summarizing the order is sent to the Customer. The Seller reserves the right to cancel any order in the event of an existing dispute with the Customer or suspected fraud.

5. Payment

Payment is made online when ordering, using the methods offered on the checkout page. Payments are processed securely by the Website's payment providers; the Seller never has access to the Customer's card details.

6. Shipping

• United States, Canada, Mexico: $7.50; free shipping on orders of $50 or more. Estimated delivery: 5 to 8 business days after shipment.
• France, Germany, United Kingdom: €4.99; free shipping on orders of €45 or more. Estimated delivery: 3 to 5 business days after shipment.

The Customer must check the package upon receipt and report any issue to contact@kyroxprotein.com as soon as possible.

7. 30-day money-back guarantee

The Customer has 30 days from receipt of the products to return all or part of the order, without giving any reason, by notifying the Seller at contact@kyroxprotein.com, then returning the products within 14 days of that notification to the address provided by customer service. Return shipping costs are borne by the Customer.

Only unopened bags in their original, intact packaging can be returned and refunded. For hygiene and health protection reasons, opened bags cannot be taken back. This does not affect the legal warranties in section 8 for defective or non-conforming products.

The Seller refunds the price of the returned products and the initial standard shipping costs (pro rata for partial returns) using the original payment method, within 14 days of being informed of the Customer's decision, and no later than upon receipt of the products.

8. Legal warranties

The Seller is bound by the legal warranties applicable in the Customer's country, including the warranty of conformity and the warranty against hidden defects. For any claim: contact@kyroxprotein.com.

9. Liability

The Seller cannot be held liable for use of the products that does not comply with the directions and warnings, or for reactions related to an allergy or intolerance to an ingredient listed on the packaging. Information on the Website is provided for informational purposes and does not constitute medical advice.

10. Personal data

Data collected when ordering is necessary to process the order and manage the customer relationship. It is processed in accordance with our Privacy Policy, which sets out its purposes, retention periods and the Customer's rights.

11. Customer service, disputes and governing law

Customer service: contact@kyroxprotein.com. In the event of a dispute, the Customer first sends a written complaint to the Seller, who undertakes to seek an amicable solution. These Terms of Sale are governed by French law, without prejudice to the mandatory consumer protection provisions of the Customer's country of residence. Failing an amicable agreement, disputes between businesses fall under the exclusive jurisdiction of the Commercial Court of Paris; consumers may bring proceedings before any court with jurisdiction under applicable law, including the court of their place of residence.
